Terms & Conditions

A completed “Vacation Rental Agreement” is required within 24-hours to secure your reservation. The booking fee is due to hold your reservation. Review and acceptance of the Ontario Cottage Rentals Inc. Terms & Conditions which is made part of the vacation rental agreement is required, as well as the booking fee before a confirmation will be issued.

RATES: 
Rates are quoted on a per night or per week basis as noted. Unless specified, check-in time is after 4:00 p.m., and checkout by 10:00 a.m. on the day of departure. Rates quoted are subject to a per person, per day charge. Charges vary and are subject to change without notice. All rental properties represented by Ontario Cottage Rentals Inc. come fully equipped with a refridgerator, stove, BBQ, dishes and utensils and an initial supply of paper goods. Other amenities vary per property.

RESERVATIONS AND PAYMENTS: 
Payment of the applicable 13% booking fee amount together with a completed Guest Reservation Application must be received and approved by Ontario Cottage Rentals Inc. before a confirmation will be issued. No grace period will apply. Second payment, consisting of hlaf of the remaining balance, must be received by Ontario Cottage Rentals Inc. within 48 hours. If after two (2) days, we have not received the second payment your reservation will be cancelled. Final payment, consisting of the remaining balance, must be received by Ontario Cottage Rentals Inc. at least thirty (30) days prior to guest arrival (or immediately if booked less than thirty (30) days in advance of guest arrival). Failure to make final payments on a timely basis will make reservation subject to cancellation.

CONDITION OF RENTAL: 
The property shall be in the same condition upon departure as at check-in, normal wear and tear excepted. Owner or an Ontario Cottage Rentals Inc. agent may enter the property at reasonable times to make repairs or provide maid service. Guest may cook in areas specifically designated for cooking. Guest must immediately notify Ontario Cottage Rentals Inc. of fire or other damage to property. Guest shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guest may not sublet or assign this vacation rental agreement. Guest shall be responsible to return all keys and gate or garage door openers upon departure. Guest shall abide by the House Rules of Ontario Cottage Rentals Inc. as provided to the Guest. Guests shall not bring any pets onto the property unless approved at time of booking. Guest will not smoke indoors. Guest will rinse feet of sand prior to entering the unit. No parties shall be allowed without prior consent. Additional charges may apply. Guest shall not permit any use of pool, hot tub, river and/or lake by unsupervised children or other guests. Guest and other invitees shall use the pool, hot tub, river and/or lake at their own risk. Guest understands that there are certain inherent risks to person and property located adjacent to rivers and lakes, including the possibility of drowning or hypothermia. Guest acknowledges that the owner would not rent the property unless the Guest accepted this condition.

SECURITY DEPOSIT: 
Ontario Cottage Rentals Inc., shall be entitled to collect from the Vacationer a returnable deposit as security for the undertaking of the rental. The Security Deposit can be fully forfeited should the Vacationer violate the terms and conditions of the Rental Agreement. Accidental Damage Insurance covers any small unintentional damages that occur during the period of the rental. The Vacationer may be asked about the circumstances around the damage. Ontario Cottage Rentals Inc., reserves the right to be the final arbiter in any malicious damage claims made by the Owner, and to determine the amount of any full or partial payment to the owner made from this deposit. The Vacationer shall be solely responsible for any and all malicious damages caused, long distance phone or internet charges incurred, regardless of which Vacationer caused or incurred the damage or charges and why, during the rental period. The Vacationer shall advise Ontario Cottage Rentals Inc., immediately of any problems, deficiencies or concerns with the rental property, and is encouraged to document such issues to avoid penalty. Additionally, Vacationers must also disclose any concerns or damage, should anything arise during the rental period. The Vacationer shall not exceed the maximum occupancy of the rental property, or exceed the number stated in the rental application form that was submitted and approved. Failure to comply will result in forfeit of the security deposit.

LIMITATION OF LIABILITY: 
Under no circumstances shall Ontario Cottage Rentals Inc. or the property Owner be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Ontario Cottage Rentals Inc. or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Ontario Cottage Rentals Inc. , at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Ontario Cottage Rentals Inc. will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include fishing, waterskiing, boating, golfing, swimming, boogie boarding, hiking, biking, skiing, snowmobiling and ice fishing. This list is not all-inclusive, but indicates some of the hazards of vacationing at a cottage property. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, decks with spaces between rails (dangerous for little children), precipitous drop-offs on river or lake floor, unfenced pools and/or hot tubs, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways. Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this cottage property, you acknowledge that in all events and circumstances, Ontario Cottage Rentals Inc., its officers and employees shall not be liable. Ontario Cottage Rentals Inc. reserves the right to cancel or rescind any vacation rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Ontario Cottage Rentals Inc. House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the vacation rental agreement.

NOTICE OF ABSENCE: 
You must tell us in advance if you will be absent from the property for two (2) days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES: 
If you stay in the cottage property, without written permission, after the Rental Agreement has ended, you will be a holdover tenant and may be liable for twice rent under the Rental Agreement on a prorated daily basis for each day you are a holdover tenant. If you leave any personal property, you must contact Ontario Cottage Rentals Inc. and if the lost item is located, Ontario Cottage Rentals Inc. will mail the item to you at a fee of $50.00 plus Shipping and Handling. After 20 days, if an item is found and you do not contact Ontario Cottage Rentals, we may donate the found item to a charitable organization.

ACCIDENTAL DAMAGE INSURANCE: 
The Accidental Damage Insurance covers any unintentional damages, during the vacation period, declared to Ontario Cottage Rentals Inc. at time of incident. Photos of the damages are to be taken and provided to Ontario Cottage Rentals Inc. immediately. Ontario Cottage Rentals Inc. reserves the right to be the final arbiter in any insurance claims.

CANCELLATION AND REFUNDS: 
Ontario Cottage Rentals Inc., reserves the right to consider the rental cancelled in the following circumstances:
If the Vacationer provides written notification of cancellation; 
If the Vacationer a) fails to pay the balance of the rental by the time specified, b) in the event that the booking is cancelled, Ontario Cottage Rentals Inc., without being obliged to do so, may attempt to rebook the property.
* If the booking is cancelled more than one month before the booking date, the Vacationer is refunded all monies, less the 13% non-refundable booking fee.
* If the booking is less than one month, the Vacationer is refunded all monies, less the 13% non-refundable booking fee, IF the cottage is rebooked. If the cottage is not rebooked, there will be no refund.
If the rental property has been damaged by unforeseen circumstances, such as fire or flood, or acts of nature, and has been deemed “not rentable”. 
If the property has been subject to power of sale action, Ontario Cottage Rentals Inc., will make every effort to find another suitable alternative rental for the rental period. In the event that Ontario Cottage Rentals Inc., is unable to find another option, the agreement shall become null and void and all payments will be refunded to the Vacationer. 
If there are inconveniences during the cottage rental due to appliance failure, technical difficulties or hydro disruptions/outages, no refunds or discounts will be given. Ontario Cottage Rentals Inc., will make every effort to assist and solve these problems within reasonable means. 
If there is a violation of the Terms and Conditions by all or some Vacationers, Ontario Cottage Rentals Inc., reserves the right to refuse entry to the rental premises. Ontario Cottage Rentals Inc., has zero tolerance for infringement of the Rental Agreement; including, but not limited to aggressive and unruly behaviour, and will not provide a refund.

CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: 
If a catastrophe (hurricane, tornado, earthquake, flood, power outages, falling trees, etc.) or any situation simply beyond our control impairs the vacation rental, Ontario Cottage Rentals Inc. is not responsible for finding alternate lodging for the renter or for the renter’s financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS.
